Affiliate Policy
This Affiliate Policy describes the terms & conditions of the CBD Shopy Affiliate Program. By submitting the online application, you are agreeing to the terms and conditions outlined in this agreement.
1. Overview
This agreement contains the complete terms and conditions that apply to you becoming an affiliate. The purpose of this agreement is to allow HTML linking between your website and the CBD Shopy website “cbdshopy.co.uk”. Please note that throughout this Agreement, “we”, “us”, “our”, and “ours” refer to CBD Shopy (operated by Holistic Wellness Ltd.), and “you”, “your”, and “yours” refer to the affiliate.
2. Affiliate Obligations
As a member of the CBD Shopy Affiliate Programme, you will have access to the Affiliate Area. Here you will be able to download your unique affiliate URL.
CBD Shopy reserves the right, at any time, to review your placement and approve the use of Your Links and require that you change the placement or use to comply with the guidelines provided to you. The maintenance and the updating of your site will be your responsibility. We may monitor your site as we feel necessary to make sure that it is up-to-date and to notify you of any changes that we feel should enhance your performance.
Advertising via coupon code sites is not permitted.
Original materials
It is entirely your responsibility to follow all applicable intellectual property and other laws that pertain to your site. You must have express permission to use any person’s copyrighted material, whether it be a writing, an image, or any other copyrightable work. We will not be responsible (and you will be solely responsible) if you use another person’s copyrighted material or other intellectual property in violation of the law or any third-party rights.
Using our materials:
You may copy and paste only product images from our website, but not banner images, images from articles, guides or information pages. You must create your own copy (written text), copying and pasting our written text is not permitted. It is best SEO practice for you to create your own written materials (rather than reposting or copying and pasting text from any website).
Medical benefits or medical conditions
The MHRA, the UK’s government’s medicine regulatory agency, has told food supplement companies (especially those retailing CBD oil) they must not make medical claims or comment on medical conditions. This is something we have no leeway over, we simply cannot have any medical claims being made about the food supplements that CBD Shopy retails, including CBD products.
We may cancel your application if we determine that your site is unsuitable for our programme, including if it:
• Reuses or reposts any of our written material is not allowed; this includes product descriptions, information pages (including the CBD guides), FAQs or articles from our blogs. It’s essential that you create your own copy for good SEO practice. This good practice benefits both you and us.
• You may not create or design your website or any other website that you operate, explicitly or implied in a manner which resembles our website nor design your website in a manner which leads customers to believe you are CBD Shopy. You may use our product images, but not our images from articles, guides or information pages.
• Advertising via coupon code sites is not permitted.
• Incorporates any materials which infringe or assist others to infringe on any copyright, trademark or other intellectual property rights or to violate the law.
• Promotes sexually explicit materials, violence, discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age or any illegal activities.
• Is otherwise in any way unlawful, harmful, threatening, defamatory, obscene, harassing, or racially, ethnically or otherwise objectionable to us in our sole discretion.
• Contains software downloads that potentially enable diversions of commission from other affiliates in our programme.
3. CBD Shopy Rights and Obligations
3.1. We have the right to monitor your site at any time to ensure you are following the terms and conditions of this agreement. We may notify you of any changes to your site that we feel should be made, or to make sure that your links to our website are appropriate and to notify further you of any changes that we feel should be made. If you do not make the changes to your site that we feel are necessary, we reserve the right to terminate your participation in the CBD Shopy Affiliate Programme.
3.2. We reserve the right to terminate this agreement and your participation in the CBD Shopy Affiliate Programme immediately and without notice to you should you commit fraud in your use of the affiliate programme or should you abuse this program in any way. If such fraud or abuse is detected, we shall not be liable to you for any commissions for such fraudulent sales.
3.3. This agreement will begin upon our acceptance of your affiliate application and will continue unless terminated hereunder.
4. Commissions
In exchange for your sales performance, you will receive a commission. The commission structure for this programme is 10% on sales generated excluding shipping costs.
This commission is subject to modification at any time (and likely to increase if our company grows).
We shall keep accurate and up-to-date records of the data used to determine the total amount of commissions owed to you. You shall be given reasonable access to these records upon request and is available through the affiliate area on the members' page.
Any discrepancy between the amount derived Commissions owed according to these records and the actual amount of Commissions paid to Affiliate in any period or periods shall be rectified by Company within 14 days of discovering such discrepancy.
Commissions are paid on a monthly basis around the 15th day of the month. The pay period ends on the last day of the month.
In the event that you materially breach this Agreement and we terminate this Agreement within 30 days of such breach, then any accrued and payable Commissions owing to you shall be forfeited, and we shall not be obligated to pay such Commissions to you.
5. Confidentiality
Any information that you are exposed to by virtue of its relationship with us under this agreement, which information is not available to the general public, shall be considered to be "Confidential Company Information". You may not disclose any Confidential Company Information to any person or entity, except where compelled by law, unless you obtain prior written consent for such disclosure from us.
6. Taxes
Each party is responsible for their own taxes.
7. Termination
Either you or we may end this agreement at any time, with or without cause, by giving the other party written notice. Written notice can be in the form of an email. In addition, this Agreement will terminate immediately upon any breach of this Agreement.
8. Modification
We may modify any of the terms and conditions in this agreement at any time at our sole discretion. In such event, you will be notified by email. Modifications may include, but are not limited to, changes in the payment procedures and the CBD Shopy Affiliate Program rules. If any modification is unacceptable to you, your only option is to end this agreement. Your continued participation in the CBD Shopy Affiliate Programme following the posting of the change notice or new Agreement on our site will indicate your agreement to the changes.
